Withdrawal from the collective action
You may withdraw from the collective action at any time, subject to the conditions set out below.
Voluntary withdrawal.
You may withdraw via the user portal or by sending an email to info@mijnenergieclaim.nl. Your withdrawal will take effect once it has been processed and confirmed by the Foundation. The Foundation will then confirm your withdrawal by email.
Time of withdrawal
Please note:
- Withdrawal is always possible, but the procedure may differ after certain statutory time limits, such as court-ordered opt-out or opt-in dates under Dutch law (WAMCA).
- If a settlement has been declared binding by the court, different rules may apply.
The Foundation will inform participants in good time of all relevant deadlines.
After termination:
- You will no longer receive updates from the Foundation regarding (the progress of) this claim.
- Even after withdrawal you may still be entitled to compensation. If SCJ is appointed as the exclusive representative, you will remain part of the group unless you formally opt out within one of the two opt-out periods set by the court.
Privacy
If you would like to know more about your rights under the GDPR, such as the right to erasure, please consult our privacy policy. It also describes how the Foundation handles retention periods.
